Part 1 — General Terms, Purchases, Payments & Refunds

1. Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "Client," "User," "Member," or "Participant") and A Wise Approach LLC, doing business as Fingertip Facelift® ("Company," "we," "us," or "our"). By purchasing, accessing, downloading, viewing, participating in, subscribing to, enrolling in, or otherwise using any Fingertip Facelift® product, service, content, platform, membership, coaching program, challenge, community, training, AI-powered tool, website, application, or offer, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our products or services. These Terms apply to all current and future products and services offered by the Company unless otherwise stated in writing.

2. Definitions

"Company" means A Wise Approach LLC, Fingertip Facelift®, its owners, officers, employees, contractors, affiliates, representatives, successors, and assigns. "Content" means all videos, audios, PDFs, downloads, worksheets, graphics, photographs, images, emails, trainings, routines, methodologies, educational materials, text, course materials, community content, AI-generated outputs, prompts, workflows, and related materials. "Products" means any digital product, course, challenge, training, audio, video, PDF, download, membership, subscription, coaching program, AI-powered tool, consultation, workshop, live event, or other offering sold or provided by the Company. "Membership" means any recurring-access product, subscription, community, coaching container, content library, or similar recurring service. "Community" means any group, forum, platform, messaging thread, social media group, comment section, coaching space, live chat, or member interaction area operated by the Company. "AI Product" means any software, routine builder, recommendation engine, chatbot, assessment tool, automation, or personalized content system utilizing artificial intelligence, automation, algorithms, user inputs, or dynamic content generation.

3. Eligibility

You must be at least eighteen (18) years of age to purchase or use our Products. By purchasing or using any Product, you represent and warrant that: you are at least 18 years old; you have the legal capacity to enter into a binding agreement; all information you provide is truthful and accurate; and your use of the Products does not violate any applicable law, regulation, or contractual obligation. If we discover that a purchaser has misrepresented their age or eligibility, we reserve the right to terminate access immediately.

4. Scope of Services

The Company provides educational products and services related to beauty, facial sculpting, skin appearance, wellness education, self-development, confidence, personal growth, and related topics. Products may include digital courses, mini-courses, challenges, audio and video trainings, PDF resources, memberships, coaching, group programs, workshops, AI-supported products, live trainings, and future educational products. The Company reserves the right to modify, improve, update, discontinue, replace, suspend, or remove Products, features, bonuses, content, delivery methods, or platforms at any time.

5. Product Access

Upon successful purchase, you will receive access to the applicable Product as described on the sales page at the time of purchase. Access may be delivered through websites, mobile applications, audio and video platforms, community platforms, email, download links, messaging platforms, AI tools, or other delivery systems selected by the Company. You are responsible for maintaining internet access, device compatibility, email access, password security, and any required software. The Company is not responsible for technical issues arising from your devices, software, internet connection, email settings, spam filters, browser configuration, or third-party systems.

6. Pricing

All prices are listed in U.S. Dollars unless otherwise specified. We reserve the right to change pricing at any time. Price changes will not affect purchases already completed prior to the change. The Company may offer discounts, coupons, promotions, bonuses, bundles, payment plans, or special pricing at its sole discretion. A customer is not entitled to receive future discounts or bonuses not included at the time of purchase.

7. Payment Authorization

By purchasing a Product, you authorize the Company and its payment processors to charge your selected payment method for all amounts due. You represent that you are authorized to use the payment method submitted, that payment information is accurate, and that you will maintain valid payment information throughout any payment plan or subscription period. The Company reserves the right to refuse or cancel purchases suspected of fraud, unauthorized use, abuse, or violation of these Terms.

8. Payment Plans

The Company may offer payment plans as a convenience. A payment plan is not a subscription; it represents a commitment to pay the full purchase price over time. By selecting a payment plan you agree that the full amount is owed; future payments remain due regardless of participation, completion, dissatisfaction, or personal circumstances. You authorize the Company to charge the payment method on file for all scheduled installments. If a payment fails, access may be suspended until the account is brought current. The Company reserves the right to pursue collection of unpaid balances to the fullest extent permitted by law.

9. Failed Payments

If a payment attempt fails, the Company may retry the payment method, request updated billing information, suspend access, remove community or coaching access, revoke bonuses, or terminate participation. Any outstanding balance remains due and payable. Failure to complete payment obligations may result in collection efforts, recovery costs, administrative fees, and reasonable attorney's fees where permitted by law.

10. Memberships and Subscriptions

Certain Products may be sold as memberships or recurring subscriptions. By enrolling, you authorize recurring charges according to the billing frequency displayed at checkout. Memberships may include communities, content libraries, coaching access, group calls, AI tools, ongoing trainings, and bonus resources. The Company may add, modify, remove, or update membership content at any time. Membership access is a benefit of active enrollment and does not create ownership rights in the content.

11. Subscription Renewals

Subscriptions automatically renew unless canceled before the next billing cycle. By enrolling, you authorize recurring charges until cancellation. It is your responsibility to manage your subscription and cancellation preferences. Failure to cancel before renewal does not entitle you to a refund. The Company may provide renewal reminders but is not obligated to do so.

12. Subscription Cancellation

You may cancel a subscription by following the instructions within the platform or by contacting help@fingertipfacelift.com. Cancellation prevents future billing only. It does not refund prior payments or the current billing period, create prorated refunds, or eliminate outstanding balances. Unless otherwise stated, access continues through the end of the current billing cycle.

13. Refund Policy

Because our Products are primarily digital and often provide immediate access to proprietary educational materials, all sales are final unless a specific written refund policy is expressly stated on the Product sales page at the time of purchase. Absent a written refund policy, no refunds will be issued for change of mind, buyer's remorse, accidental purchases, failure to use or complete the Product, lack of results, personal circumstances, time constraints, customer-side technology issues, forgotten renewals, duplicate purchases, or failure to read the sales page or these Terms. Any refund exception must be explicitly stated in writing by the Company.

14. Chargebacks and Payment Disputes

Before initiating a chargeback, dispute, reversal, or payment claim, you agree to contact help@fingertipfacelift.com and provide a reasonable opportunity to resolve the issue. Initiating a chargeback does not automatically cancel payment obligations. If a chargeback is determined to be inconsistent with these Terms, the Company may revoke Product, membership, community, or coaching access, terminate participation, and restrict future purchases. The Company may provide proof of purchase, usage records, access logs, communications, and these Terms to payment processors or financial institutions.

15. Bonuses

The Company may offer bonuses, gifts, additional resources, live trainings, coaching sessions, templates, or downloads at its discretion. Unless expressly stated otherwise, bonuses have no separate cash value, are not guaranteed indefinitely, may be modified, replaced, or removed, and do not create refund rights.

16. Product Availability

The Company makes reasonable efforts to maintain Product availability but does not guarantee uninterrupted access. Products may occasionally be unavailable due to maintenance, updates, platform changes, technical issues, third-party outages, security concerns, or circumstances beyond our control. Temporary interruptions do not create entitlement to refunds, credits, damages, or compensation.

17. Reservation of Rights

The Company reserves all rights not expressly granted in these Terms. Purchase of a Product grants limited access rights only and does not transfer ownership of any intellectual property, methodology, framework, routine, system, or content.

18. Educational Purpose Only

All Fingertip Facelift® Products are provided for educational, informational, and self-development purposes only. Content may relate to facial sculpting, skin appearance, wrinkles, puffiness, tension patterns, posture, breathing, confidence, beauty practices, personal development, wellness concepts, self-image, and natural beauty approaches. Nothing contained in any Product should be interpreted as medical advice, healthcare, diagnosis, treatment, prevention, or cure of any disease, disorder, injury, condition, or symptom.

19. Medical Disclaimer

The Company is not providing medical care. Neither A Wise Approach LLC, Fingertip Facelift®, Allison Wise, nor any representative of the Company is acting as your physician, dermatologist, esthetician, physical or occupational therapist, psychologist, counselor, therapist, psychiatrist, nutritionist, or any healthcare or medical professional. Nothing in our Products should be construed as medical, dermatological, or psychological advice, mental health or healthcare treatment, clinical recommendations, or professional diagnosis. Always seek the advice of a qualified healthcare provider regarding medical concerns, and never disregard professional medical advice because of information obtained through our Products.

20. Acknowledgment Regarding Health Conditions

By participating in any Product, you acknowledge that you are solely responsible for determining whether participation is appropriate for you. You agree to consult a qualified healthcare provider before participation if you are pregnant or postpartum, have undergone recent surgery, or have a medical, skin, neurological, cardiovascular, chronic-pain, physical, or mental-health condition, a history of seizures, or any condition that could be affected by participation. Participation is entirely voluntary.

21. Assumption of Risk

You understand that participation may involve facial touch, facial massage, facial sculpting, self-administered pressure techniques, stretching, breathing exercises, mobility practices, posture work, and self-observation exercises. You voluntarily assume all risks associated with participation. Outcomes may vary and participation may involve unforeseen risks. The Company cannot and does not guarantee safety, effectiveness, suitability, or results for every individual.

22. Safety Guidelines

You agree to use Products only in a safe environment. You should not participate while driving, operating machinery, performing tasks requiring full attention, under the influence of alcohol, recreational drugs, or judgment-impairing substances, or in any unsafe situation. Discontinue immediately if you experience pain, dizziness, nausea, numbness, tingling, swelling, skin irritation, emotional distress, shortness of breath, or any reaction that concerns you.

23. No Guarantee of Results

The Company does not guarantee any particular result, including appearance, skin changes, wrinkle or puffiness reduction, facial symmetry, confidence, self-image, or any lifestyle, personal, business, financial, or health outcomes. Results depend on numerous factors beyond our control, and every individual is different.

24. Testimonials Disclaimer

Testimonials, reviews, comments, screenshots, messages, videos, photographs, social-media posts, before-and-after images, and customer stories are provided for illustrative purposes only and represent individual experiences. They do not constitute guarantees, promises, warranties, or predictions of future results. Any examples presented should not be considered typical unless expressly stated otherwise.

25. Before-and-After Disclaimer

Before-and-after photographs are provided for educational and illustrative purposes. Various factors may influence appearance, including lighting, camera angle, facial expression, camera quality, makeup, hydration, sleep, posture, consistency, and individual anatomy. They should not be interpreted as promises of future outcomes.

Intellectual Property

26. Ownership of Intellectual Property

All Products and Content remain the exclusive property of A Wise Approach LLC, including all rights, title, and interest in videos, audios, PDFs, downloads, worksheets, workbooks, graphics, images, emails, training materials, scripts, routines, methodologies, protocols, frameworks, systems, educational concepts, product/program/offer names, logos, branding, trademarks, copyrights, proprietary business methods, and AI-supported workflows, routines, and recommendations. No ownership rights are transferred to customers.

27. Limited License

Upon purchase, the Company grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable limited license to access and use the Product for your own personal use, subject to compliance with these Terms. Violation may result in immediate termination of the license.

28. Account Sharing Prohibited

One purchase grants access to one individual. You may not share login credentials or account access, or allow another person to use your account or access paid materials through it. The Company reserves the right to suspend or terminate accounts suspected of unauthorized sharing.

29. Prohibited Uses

Without express written permission, you may not copy, reproduce, republish, upload, share, distribute, sell, resell, license, transfer, rent, broadcast, or publicly display Products, create derivative works, or incorporate Products into another program. Violation may result in termination and legal action.

30. Use With Clients Prohibited

Unless expressly authorized in writing, Products may not be used with clients, customers, patients, students, members, participants, or coaching/consulting clients, whether paid or unpaid. Purchasing a Product does not grant the right to teach, facilitate, coach, advise, demonstrate, deliver, or apply the Product on behalf of others.

31. Reverse Engineering Prohibited

You may not attempt to reverse engineer, deconstruct, recreate, replicate, copy, extract, rebuild, or derive any proprietary aspect of the Fingertip Facelift® methodology, including routines, educational systems, sequences, frameworks, protocols, training methods, product structures, content organization, and AI-supported tools, workflows, and recommendations.

32. Competing Products

You may not use our Products to create, improve, train, benchmark, develop, market, or sell competing products, courses, memberships, certifications, coaching programs, trainings, methodologies, or AI systems, whether free or paid.

AI Products

33. AI-Supported Features

The Company may offer AI-supported features including routine builders, recommendation engines, personalized content, assessments, educational assistants, chat-based tools, and automated guidance systems. These tools are educational tools only.

34. AI Output Disclaimer

AI-generated content may contain errors, omissions, inaccuracies, outdated or incomplete information, or recommendations that are not appropriate for your circumstances. You are solely responsible for evaluating any AI-generated output before relying upon it. AI output should never be considered medical advice.

35. AI Changes

The Company reserves the right to modify, replace, retrain, remove, suspend, or change AI tools or functionality without prior notice.

36. User Inputs

If you provide photographs, answers, goals, preferences, assessments, or other information to an AI-supported Product, you represent that you have the right to provide the information, that it is accurate to the best of your knowledge, and that it does not violate another person's rights. Aside from the private progress photos described in Section 46A (which are governed by our Privacy Policy), you should not submit highly sensitive information through AI-supported tools.

Account Security

37. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. If you believe unauthorized access has occurred, you must notify us promptly.

38. Monitoring

The Company reserves the right to monitor Product access and usage for purposes including security, fraud prevention, intellectual-property protection, technical troubleshooting, and policy enforcement. Monitoring does not create any obligation to monitor.

39. Reservation of Rights

The Company reserves all rights not expressly granted under these Terms. No license, ownership right, certification, franchise, partnership, agency relationship, or business opportunity is created by participation in any Product.

Communities and Participation

40. Community Access

Certain Products may include access to Communities, which may include groups, forums, discussion boards, group-coaching spaces, live trainings, comment sections, and community platforms. Community access is a privilege, not a right. The Company reserves the right to restrict, suspend, or terminate Community access at any time in its reasonable discretion.

41. Community Conduct

You agree to conduct yourself respectfully and professionally. You may not harass, bully, threaten, discriminate against, intimidate, stalk, or doxx others; post offensive or illegal content; disrupt discussions; engage in abusive behavior; share another person's confidential information; or engage in unwanted solicitation or spam. The Company may remove content or participants at any time; removal does not create entitlement to a refund.

42. Confidentiality of Community Discussions

Community participation may expose you to personal information shared by other participants. You agree to keep confidential any personal, private, sensitive, business, emotional, health-related, or identifying information disclosed by other participants, and you may not share, republish, record, screenshot, or distribute participant information without express permission. These obligations survive termination.

43. Recording and Screenshot Restrictions

The Company's Products, Communities, coaching calls, live trainings, member discussions, presentations, and educational materials are proprietary. Unless expressly authorized in writing, you may not record calls, trainings, or coaching sessions; screenshot paid content or member discussions; or download, distribute, republish, or share protected content or recordings.

44. Non-Solicitation

While participating in any Product, Community, coaching container, creator program, affiliate program, membership, challenge, event, or training, and for twelve (12) months thereafter, you agree not to directly or indirectly recruit or solicit Company customers, contractors, employees, affiliates, or creators, or market or move members into competing programs, for the purpose of competing with the Company.

45. Reputation Protection and Anti-Harassment

The Company welcomes honest feedback and lawful consumer reviews. However, you agree not to engage in defamation, harassment, threats, intimidation, knowingly false statements, doxxing, impersonation, coordinated attacks, or malicious conduct intended to damage the Company. Nothing in this section is intended to prohibit lawful reviews, protected speech, or good-faith complaints.

Testimonials, Photos, Videos, and Shared Content

46. Permission to Use Submitted Content

This section applies only to content you voluntarily submit to us as feedback, testimonials, stories, or community participation. If you submit, send, email, message, upload, comment, post, tag, share, or publish content to the Company, Fingertip Facelift®, Allison Wise, Company representatives, official Company accounts, or Company platforms — or respond to a request from the Company — you grant the Company permission to use that content. Submission of such content constitutes consent to such use.

46A. Private Progress Photos (App) — Not Submitted Content

Progress photos you upload within the app for your own progress tracking are private and are NOT "submitted content" under Sections 46–50. They are stored privately, are visible only to you, are governed by our Privacy Policy, and are never used for marketing, testimonials, advertising, or any purpose other than providing the progress-tracking feature to you. We do not use them to train AI or create facial-recognition profiles. You may delete them at any time. If we later offer optional photo analysis, it will require your separate, explicit consent as described in the Privacy Policy.

47. Scope of Permission

The permission granted under Section 46 includes the right to reproduce, publish, display, share, repurpose, edit, shorten, crop, and reformat content, and to use it in marketing, educational materials, promotions, advertisements, trainings, websites, emails, and social media. The Company may use first names, usernames, photographs, videos, screenshots, written communications, testimonials, reviews, voice notes, and before-and-after images unless otherwise requested. (This does not apply to private progress photos under Section 46A.)

48. Editing and Formatting Rights

The Company may correct spelling and grammar, shorten submissions, crop images, redact personal information, remove identifying details, reformat content, and adapt content for various platforms, provided the substance of the communication is not materially altered.

49. Opt-Out Procedure

You may withdraw permission for future use of your submitted content by emailing help@fingertipfacelift.com with the subject line TESTIMONIAL OPT OUT. Upon receipt, the Company will make reasonable efforts to discontinue future use. You acknowledge the Company may not be able to remove previously distributed, published, archived, or printed content, or content already shared by third parties, prior to processing your request.

50. Ownership of Submitted Content

You represent that you own the content you submit, have authority to submit it, and that submission does not violate another person's rights or infringe intellectual-property rights. You remain the owner of your original content; the permission granted to the Company is a non-exclusive, royalty-free, worldwide license.

Coaching, Creator Programs, and Affiliates

51. Coaching Disclaimer

Coaching is educational in nature and does not constitute medical care, therapy, counseling, legal advice, financial advice, or professional services. The Company does not guarantee specific outcomes from coaching participation.

52. Participation Responsibility

You are responsible for your attendance, participation, implementation, decision-making, personal actions, and personal outcomes. The Company is not responsible for results resulting from your failure to participate or implement.

53. Recording of Live Events

Live trainings, coaching calls, workshops, and events may be recorded. By participating, you acknowledge that your name, voice, video, chat messages, questions, and participation may appear in recordings and replays. If you do not wish to appear, refrain from sharing identifying information and keep your camera disabled.

54. Affiliate and Creator Programs

The Company may operate affiliate, referral, ambassador, or creator programs. Participation is subject to Company approval, and the Company may suspend, revoke, deny, or terminate participation at any time.

55. FTC Compliance

Affiliates and creators must comply with all applicable laws, regulations, platform policies, and disclosure requirements. Required disclosures must be made when promoting Company Products.

56. Prohibited Creator and Affiliate Claims

Creators and affiliates may not make medical claims, guarantee results, promise outcomes, guarantee income or business growth, misrepresent Products or Company policies, represent themselves as Company employees, or make false statements regarding Products. Violation may result in immediate termination.

Limitation of Liability

57. No Warranties

Products are provided on an "as-is" and "as-available" basis. The Company disclaims all warranties to the fullest extent permitted by law and does not warrant that Products will be uninterrupted, error-free, meet expectations, or achieve desired outcomes.

58. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, or opportunities, emotional distress, reputational harm, data loss, or business interruption arising out of Product use. The Company's total liability shall not exceed the amount paid by you for the specific Product giving rise to the claim.

59. Assumption of Responsibility

You acknowledge that you are solely responsible for your participation, decisions, actions, implementation, and results, and you assume all responsibility associated with your use of Products.

60. Indemnification

You agree to indemnify, defend, and hold harmless the Company from claims, damages, losses, liabilities, costs, and expenses arising out of your use or misuse of Products, your violation of these Terms, your infringement of another person's rights, your content submissions, or your conduct within Communities, including reasonable attorney's fees where permitted by law.

61. Force Majeure

The Company shall not be liable for delays, interruptions, failures, or inability to perform resulting from circumstances beyond its reasonable control, including internet, platform, AI-provider, or payment-processor outages, cyberattacks, natural disasters, government actions, pandemics, labor disputes, illness, acts of God, and technical failures. The Company's obligations shall be suspended for the duration of such events.

Dispute Resolution

62. Informal Resolution

Before initiating legal proceedings, you agree to contact help@fingertipfacelift.com and provide a good-faith opportunity to resolve the dispute.

63. Binding Arbitration

Any dispute arising out of or relating to these Terms, Products, services, Communities, memberships, subscriptions, coaching, creator programs, or affiliate programs shall be resolved through final and binding arbitration. Arbitration shall be conducted in Texas unless otherwise required by law. The parties waive the right to trial by jury.

64. Class Action Waiver

All claims must be brought individually. You agree not to participate in class actions, collective actions, representative actions, or consolidated proceedings to the fullest extent permitted by law.

65. Small Claims Exception

Nothing in these Terms prevents either party from bringing a qualifying claim in small claims court where permitted by law.

66. Governing Law

These Terms shall be governed by the laws of the State of Texas without regard to conflict-of-law principles.

67. Venue

For matters not subject to arbitration, exclusive venue shall lie in the state or federal courts located in Texas. You consent to personal jurisdiction in those courts.

68. Limitation Period

Any claim arising from these Terms must be brought within one (1) year after the claim arises. Claims brought after that period are permanently barred to the fullest extent permitted by law.

Final Legal Provisions

69. Termination

The Company may suspend, revoke, or terminate access at any time for violation of these Terms. Termination does not entitle you to a refund.

70. Survival

The following provisions survive termination: payment obligations, intellectual-property protections, confidentiality obligations, testimonial permissions, liability limitations, indemnification, arbitration provisions, governing-law provisions, and any provision intended to survive by its nature.

71. Assignment

The Company may assign these Terms at any time. You may not assign your rights without written permission.

72. Severability

If any provision is found unenforceable, the remaining provisions remain enforceable.

73. No Waiver

Failure to enforce any provision shall not constitute a waiver of future enforcement.

74. Entire Agreement

These Terms, together with any Privacy Policy, Disclaimer, Product-specific terms, checkout terms, and written agreements, constitute the entire agreement between you and the Company.

76. Plain-English Summary

In simple terms: Our Products are educational, not medical. Results vary and are not guaranteed. Digital purchases are generally final. Payment plans remain due even if you stop participating. Memberships renew until canceled. Our content cannot be copied, taught, shared, or resold. Communities must remain respectful and confidential. If you voluntarily share photos, videos, testimonials, messages, screenshots, or results with us, you give us permission to use them (and may opt out by emailing help@fingertipfacelift.com) — but private progress photos you upload in the app stay private to you and are never used for marketing. You are responsible for your own decisions, participation, and results. Disputes are resolved individually through arbitration.
